Salary not paid. Lost communication

Sunday 01 Feb 2009

Hi. I worked with a company on part-time hours while I went part-time on my original job. The company went bust after I was about a month into the job. They are not in administration or something. I have repeatedly left messages with the persons in charge who always tell me they will email me or get back to me. But never have. None of the managers from the company remain and neither are they contactable. I don't know WHO to talk to about my loss of income, even though they said they would pay. They haven't even sent me any paperwork that they sent to other employees about what was to happen next.

Sacked for taking time off at xmas to see mother interstate

Saturday 31 Jan 2009

My daughter was working for a take away food outlet as a certificate 3 Retail Operations. She was highly regarded after 2 months and asked her manager if she could take 2 weeks leave at xmas to visit her mother interstate, she hadn't seen her in over 2 years. The manager gave her permission verbally, this was 1 month prior to xmas. Just before xmas, my daughter told the owner of the franchise her flight details, to my daughters' horror, she was told if she didn't show for work she would be sacked and was called a liar when told permission was granted by the manager. I assume the message wasn't passed on. I have been in touch with Skills Victoria, who had a meeting with the company and she was given all allegations that my daughter was always late, not competent, etc. All lies to support her decision to sack my daughter. Apparently because she was within a 3 month trial, the contract with the apprenticeshp board can be cancelled at anytime, what's the point of a contract then? Anyway, now my daughter, who is 17, has lost motivation and trust in looking for future employment. I am disgusted at the companies behaviour and want to take further action but not sure where to go from here. Any suggestion would be appreciated.

HOLIDAYS TAKEN AS "Sick Days"

Friday 30 Jan 2009

I work in a real estate office as a property manager. I have been there for 1.5years. The office was closed for holidays and i was expecting to be paid, only i wasnt. When i returned to work and questioned the boss he has stated that i have taken 40 days "paid" sick days, therefore am not entitled to holidays. Does he have to tell me his plans of using my"sick" days (which im sure are not 40) as my holidays prior to doing this? I have never signed any employment contracts and have never signed anything to agree to loose my holidays to sick days... I also have never been paid any holiday loading on holiday pay... Is he allowed to take away holidays without me signing them over?

Full time apprentice stood down for days on end, without pay, due to poor supervisor

Thursday 29 Jan 2009

please excuse double post, stuffed up title.... I am a full time employee doing an apprenticeship in spray painting. Each time my supervisor has a disagreement with me, i am dismissed from work, without pay, until he or my boss decides that either "i" am to call the apprenticeship board to cancel my contract, or they decide they want me back. example being today, i was told i was taking too long on a job, so i asked my supervisor to show me how to do it faster, and he had a go at me saying to stop talking and keep working. later he came back having a go at me, said that was all he had to say, walked off and started up again, i questioned why he didnt say it earlier, so he sent me home. i was sent home after 1hr30min work, in which time i had finished my job, sanding down a primed boot lid for a holden ute. during the period i am told to not come in to work, being 15hrs worth of my wage, i am without pay as a full time employee... do they have the right to stand me down without pay because my supervisor gets annoyed at times?

Wednesday 28 Jan 2009

My son is a second year apprentice he is only 17 so im the guardian. He was told by his boss not to come back to work. His boss has not paid loading on his holiday pay for 2 years and has never paid him for his overtime. My son stopped doing overtime because he wasn't get paid for it now his boss has sacked him.His boss said he gave my son three written warnings but my son would not take a copy my son has not signed anything and i have not even seen or heard that he has these warnings. Can he do this? It seems really unfair and i thought i was notified of any problems. His boss said he sacked him because of his attitude and not wanting to work past his normal hours.

Is this fair?

Wednesday 28 Jan 2009

I work in admin and i got a call to pick my daughter up from day care cos she wasn't well. My husband had to pick her up. As he had to work a afternoon shift I was going to leave early but my boss had a talk to me and told me that if it's not an emergency that i should find someone else to look after her and that I could leave 1 hr early if needed. I want to know if this is fair. All my family work and it's my responsibility to look after my children so I was very upset that she would say that to me. She doesn't want it to become "a problem". Please help me. Is it fair.
